Our agreement

These terms apply to the Swapii website and app operated by Ohvii LLC (“we,” “us”). By using Swapii, you agree to these terms and acknowledge our Privacy Policy. If you do not agree, do not use the service. Questions can be sent to hi@swapii.app.

Swapii is currently in development. Prerelease features and availability may change, and a public launch date has not been announced.

Your account

You must be at least 13, or the higher minimum age required where you live, to use Swapii. If you are not old enough to enter this agreement independently, you must have permission from a parent or legal guardian who agrees to these terms. Provide accurate account information, protect your sign-in credentials and tell us if you suspect unauthorized use. You are responsible for activity you authorize through your account.

Sharing clothes with friends

Swapii helps people coordinate; it does not own, inspect, insure, ship or take custody of the clothes you share. You and the other person are responsible for agreeing on the item, condition, handoff, return date, cleaning and any other arrangements before sharing.

A borrow is temporary and does not transfer ownership. A swap or gift transfers ownership only when the participants agree and complete the handoff. App records help you coordinate but do not guarantee that an item was delivered, returned or accurately described. Do not offer an item you have no right to share.

You are responsible for fulfilling your commitments and resolving item disputes with the other participant. Contact us about misuse of Swapii. Account deletion does not cancel obligations to another person or make an item returned.

Your photos and content

You retain ownership of the content you upload. You give us a non-exclusive, worldwide, royalty-free license to host, store, process and display it only as needed to operate and improve the service, follow your sharing instructions and meet legal obligations. This includes producing photo previews and making content available to the recipients you choose.

You must have the rights and permissions needed to upload and share your content. Do not post other people’s private information or images without permission. When content is deleted, this license ends except to the extent necessary to finish deletion, preserve lawful records or maintain copies you shared that remain available to other participants under the service’s functionality.

Keep it kind

Do not harass, threaten, discriminate against, impersonate or defraud anyone; post illegal, exploitative or non-consensual content; infringe intellectual property rights; send spam; access accounts without permission; bypass access controls; or disrupt the service.

You can block people in the app. Report abusive content or behavior to hi@swapii.app, including enough context for us to investigate. We may remove content, limit features or suspend accounts when reasonably necessary to enforce these terms, comply with law or protect people. Contact us if you believe we made a mistake.

The service and its limits

We own or license the Swapii software, design and branding. You may use the service for its intended purpose, but these terms do not transfer our intellectual property to you.

We work to keep Swapii useful and available, but cannot promise uninterrupted access, error-free records or any particular outcome between friends. To the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose or non-infringement.

To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, loss of data, or loss or damage to items exchanged between users. Nothing in these terms excludes liability that cannot lawfully be excluded, including applicable mandatory consumer rights, fraud, or other non-excludable liability.

Leaving Swapii

You can stop using Swapii at any time and request account deletion. We may suspend or end access for a serious or repeated breach of these terms, legal requirements, or risks to others. Where appropriate and legally permitted, we will provide notice and an opportunity to contact us. Terms concerning outstanding sharing responsibilities, intellectual property and applicable liability continue where needed after your use ends.

Using Swapii on Apple devices

These service terms are between you and Ohvii LLC, not Apple. Apple does not operate Swapii or handle our support. When the app becomes available through the App Store, your use is also subject to Apple’s applicable terms and the Apple Standard Licensed Application End User License Agreement, unless a different license is presented with the app. These website terms do not replace that app license.

Updates and questions

We may update these terms as the service changes. We will publish the revised terms here and provide additional notice where required. Changes apply prospectively. Any mandatory rights and protections of the laws that apply to you remain in effect.
